FlexAbilities – Billing Terms & Subscription Policy

These Billing Terms (“Billing Terms”) apply to all purchases and subscriptions made through www.flex-abilities.com (the “Site”). They form part of, and are incorporated into, our Terms of Use. By purchasing or using a FlexAbilities subscription, you agree to these Billing Terms and the Terms of Use. “FlexAbilities,” “we,” “us,” and “our” refer to FlexAbilities. “You” refers to the person purchasing or using a subscription.
1. General. FlexAbilities offers subscription-based access to digital training, stretching, and related content on the Site. All purchases and subscriptions are subject to: These Billing Terms; and Our Terms of Use and Privacy Policy (together, the “Site Terms”). Different subscription plans (for example, monthly vs. annual, or promotional plans) may be offered depending on your location or the current offers available on the Site. The subscription fee applies regardless of how much or how often you access or use your subscription during the billing period.
2. Where You Can Purchase. Subscriptions may be purchased directly from the FlexAbilities website at www.flex-abilities.com. Subscriptions purchased through the Site are managed and billed by us, using third-party payment processors.
3. Payment Processing & Security. All payments are processed securely via third-party payment gateway providers, such as Wix Payments, PayPal, or other processors we may use from time to time. You must refer to the payment provider’s terms and privacy policy for additional information about how they handle your data. All transactions are handled over SSL and are designed to be PCI-compliant. FlexAbilities does not store your full credit card details on its own servers.
4. Subscription Plans (Monthly & Annual). FlexAbilities may offer multiple subscription options, which may include, for example: Monthly plans (billed every month); Annual plans (billed once per year); and Other time-limited or promotional plans, as offered from time to time. When you choose a plan, the price, billing frequency, and key terms (such as whether there is a trial period) will be shown at checkout. Please review these carefully before completing your purchase. For annual plans, by proceeding you acknowledge and agree that: You are purchasing a full year of access billed upfront; The plan is non-refundable for the billing period, except where required by law; You could instead choose a shorter-term option (such as monthly) if available, but you have voluntarily chosen an annual commitment in exchange for the pricing offered; and You must cancel before the renewal date if you do not wish your annual plan to renew for another full year.
5. Payment Timing & Auto-Renewal. Subject to any advertised free trial, payment must be made at the time of purchase, before you have access to your subscription content. Subscriptions to FlexAbilities are automatically renewed at the end of each billing period (e.g., monthly or annually) using the payment method on file, until you cancel. By starting a subscription, you authorize FlexAbilities and/or its payment processors to charge your selected payment method automatically for recurring subscription fees and any applicable taxes for each subsequent billing period, unless and until you cancel in accordance with Section 8.
6. Your Payment Method. You are responsible for providing a valid, current payment method and keeping your billing information up to date. Unless you update your payment method, we will assume your existing payment method is valid and we will continue to bill your subscription fees to that method. If any subscription fees billed to your account are not processed for any reason (e.g., card expiration, insufficient funds, or processor decline): We may suspend or limit your access to the subscription content until payment is successfully collected; and We reserve the right to terminate your subscription if payment is not brought current within a reasonable time.
7. Changes to Subscription Fees. We may change the price of subscription plans and/or introduce new plans from time to time. Any such change: Will apply to future billing periods only (we do not retroactively increase fees for already-paid periods); and Will be communicated to you in advance where required by law (for example, via email or on-site notice). If we increase the recurring subscription fee for your plan, we will provide at least 14 days’ notice (or longer if required by law) before the change takes effect. If you do not agree to the new price, you must cancel your subscription before the end of your current billing period. By continuing your subscription after the effective date of the price change, you are deemed to have accepted the new price.
8. Cancellations. You may cancel your subscription at any time. To cancel, you can: Log in to your account, go to “My Subscriptions” (or similarly named section), and follow the cancellation prompts. To avoid being charged for the next billing period, you must cancel at least 24 hours before the start of that next period. When you cancel: Your subscription remains active until the end of the current billing period, and Your subscription will not renew for the following period. Cancelling a subscription does not automatically result in a refund of any fees already paid (see Section 9).
9. Refunds & Credits. Because FlexAbilities provides digital content and services, and you gain access to that content immediately upon purchase or at the start of a trial conversion, all subscription fees are non-refundable, except where required by law. In particular, we do not offer refunds or credits for: Unused subscription periods or time; Accidental purchases or forgetting to cancel; Changes in your schedule, circumstances, or motivation; Medical conditions, injuries, or inability to use the service; or Dissatisfaction with the content where the service is functioning as described. If you believe that a billing error has occurred (for example, duplicate charges, or you were charged despite a timely cancellation), please contact us promptly at shelby.flexabilities@gmail.com with details. We will review your request in good faith and correct any verified errors. Where refunds are required by law, they will be processed through the same payment method used for the original transaction, if reasonably possible.
10. Free Trials, Promotions & Coupons. From time to time, we may offer free trials, discounts, promotional codes, or other special offers. Any such offer is subject to the specific terms, eligibility criteria, and duration stated at the time the offer is made. Unless otherwise stated, trial subscriptions will automatically convert to a paid subscription at the end of the trial period at the standard price for your plan, and your payment method will be charged, unless you cancel before the end of the trial. Only one promotional offer or coupon may generally be applied per subscription, unless explicitly stated otherwise. We reserve the right to determine your eligibility for any promotion.
11. Chargebacks & Billing Disputes. By purchasing a subscription, you acknowledge and agree thatYou are receiving access to digital content that is delivered online; Our no-refund policy is clearly disclosed in the Terms of Use and these Billing Terms; and You will contact us first at shelby.flexabilities@gmail.com to attempt to resolve any billing-related concern before initiating a chargeback or payment dispute with your bank or card issuer. If you initiate a chargeback or payment dispute: We may suspend or terminate your access to the Site and services while the dispute is pending; We reserve all rights to provide documentation to the payment processor or bank demonstrating that the charges were valid and authorized; and If the dispute is resolved in our favor, we may reinstate access only once all outstanding amounts have been paid. Nothing in this Section limits any rights you may have under applicable law to dispute unauthorized charges (for example, charges made using your card without your permission).
12. Taxes. Subscription fees may be subject to applicable taxes, such as sales or value-added tax, based on your billing address and applicable law. Any such taxes will be added at checkout where required. You are responsible for any taxes that apply to your purchases, where not collected by us at the time of sale.
13. Collections. If we must take action to collect any unpaid subscription fees from you, and where permitted by law, you may be responsible for reasonable costs of collection, including attorneys’ fees and collection agency costs, on a full-indemnity basis.
14. Changes to These Billing Terms. We may update these Billing Terms from time to time to reflect changes in our services, pricing, or legal requirements. When we do, we will update the “Last Updated” date at the top of this page. For material changes, we may also provide additional notice (e.g., email or in-site notice) where required by law. Your continued subscription after updated Billing Terms are posted constitutes your acceptance of those changes for future billing periods.
